Guide: compare the cleaner production audit method with the interim cleaner production audit method, and summarize the changes of key contents.



1、 Background



In order to implement the Cleaner Production Promotion Law of the people's Republic of China (2012), further standardize the cleaner production audit procedures, and better guide local and enterprises to carry out cleaner production audit, the national development and Reform Commission and the Ministry of environmental protection revised the Interim Measures for cleaner production audit.



The cleaner production audit measures (No.38 order of 2016 of the national development and Reform Commission and the Ministry of environmental protection) was formally implemented on July 1, 2016 and promulgated on August 16, 2004



The Interim Measures for cleaner production audit (Order No. 16 of the national development and Reform Commission and the former State Environmental Protection Administration) shall be repealed at the same time.





2、 Comparison and summary of key changes



U 1. Change of cleaner production audit definition: increase the scheme of waste recycling and emphasize the implementation of the scheme.

2. The functional departments that organize the implementation of audit shall be delegated to the county level



Old: the administrative departments of development and Reform (economic and trade) of all provinces, autonomous regions, municipalities directly under the central government, cities specifically designated in the state plan and Xinjiang production and Construction Corps jointly with the administrative departments of environmental protection



New: the comprehensive coordination department of cleaner production designated by the local people's government at or above the county level, together with the competent environmental protection department, the Department in charge of energy conservation (hereinafter referred to as "the competent department of energy conservation") and other relevant departments




3. Increase the enterprise type of compulsory cleaner production audit: add new enterprise type



Old: (1) enterprises that discharge pollutants in excess of the national and local discharge standards, or whose total discharge exceeds the total emission control targets approved by the local people's government;



(2) Enterprises that use toxic and harmful raw materials for production or discharge toxic and harmful substances in production.



New: (1) the discharge of pollutants exceeds the national or local discharge standards, or even though it does not exceed the national or local emission standards, it exceeds the total control targets for the discharge of key pollutants;



(2) Exceeding the energy consumption quota per unit product constitutes high energy consumption;



(3) Using toxic and harmful raw materials for production or discharging toxic and harmful substances during production.




4. Refine the content of information released by enterprises: specify the contents of information to be published respectively for the three types of compulsory review units




Old: the main contents to be published shall include: the name of the enterprise, the legal representative, the address of the enterprise, the name of the pollutant discharged, the mode of discharge, the concentration and total amount of the discharge



Over standard and over total amount.



New: (1) the main information released by the enterprises that implement the compulsory cleaner production audit as stipulated in Article 8 (1) of these measures include: enterprise name, legal representative, address of the enterprise, name of pollutant discharged, mode of discharge, concentration and total amount of discharge, situation of exceeding standard and exceeding total amount.



(2) Article 8 (2) of the present Measures stipulates that enterprises that implement compulsory cleaner production audit shall publish the following main information: enterprise name and legal representative



Address of the enterprise, main energy varieties and consumption, energy consumption per unit output value, energy consumption per unit product, and exceeding the standard of energy consumption per unit product.



(3) Article 8 (3) of the present Measures stipulates that enterprises that implement compulsory cleaner production audit shall publish the following main information: enterprise name and legal representative



The address of the enterprise, the name, quantity and use of toxic and harmful raw materials, the name, concentration and quantity of toxic and harmful substances discharged, the generation and disposal of hazardous wastes, and the implementation of environmental risk prevention and control measures according to law.




U 5. Increased access conditions for advisory bodies: higher requirements

Old: (1) having independent legal personality;



(2) Technical personnel who are familiar with production process, technology and pollution control management of relevant industries, understand cleaner production knowledge, and master cleaner production audit procedures;



(3) It has the system and measures to provide fair, just and efficient service for cleaner production audit of enterprises.



New: (1) it has independent legal personality, and has a quality assurance system and management system to provide fair, just and efficient services for cleaner production audit of enterprises.



(2) Have basic detection and analysis instruments, equipment or means to carry out cleaner production audit material balance test, energy and water balance test.



(3) It has technical personnel who are familiar with the production process, technical regulations and management requirements of energy saving, water saving and pollution prevention.



(4) Have technical personnel who master cleaner production audit methods and have experience in cleaner production audit consultation.




6. Detailed approval department: comparison with the reasons for compulsory review



Old: enterprises listed in the list of compulsory cleaner production audit shall, within one year from the date of promulgation of the list, report the cleaner production audit report to the local administrative department of environmental protection and the administrative department of development and Reform (economic and trade). Enterprises directly under the central government shall submit the cleaner production audit report to the local environmental protection and development reform



(economic and trade) administrative departments, with copies to the State Environmental Protection Administration and the national development and Reform Commission.



New: the enterprises listed in Article 8 (1) and (3) of the present Measures for implementing compulsory cleaner production audit shall complete the audit within one year from the date of promulgation of the list
