the "management measures for the recycling and treatment of pesticide packaging waste" was deliberated and adopted by the 11th executive meeting of the Ministry of agriculture and rural areas on July 31, 2020, and approved by the Ministry of ecological environment. It is hereby promulgated and will come into effect on October 1, 2020.

Management measures for recycling and treatment of pesticide packaging waste
Chapter I General Provisions
Article 1 These measures are formulated in accordance with the law of the people's Republic of China on the prevention and control of soil pollution, the law of the people's Republic of China on the prevention and control of environmental pollution by solid waste, the regulations on the administration of pesticides and other laws and administrative regulations for the prevention and control of pesticide packaging waste pollution, the protection of public health and the protection of the ecological environment.
Article 2 Thesemeasures are applicable to the recycling and treatment of pesticide packaging waste in the process of agricultural production and its supervision and management.
Article 3 the term "pesticide packaging waste" as mentioned in these Measures refers to the packaging materials directly in contact with or containing pesticide residues after the use of pesticides, including bottles, cans, barrels, bags, etc.
Article 4 local people's governments at all levels shall, in accordance with the provisions of the law of the people's Republic of China on the prevention and control of soil pollution, organize, coordinate and urge the relevant departments to perform their duties of supervision and management of the recycling and treatment of pesticide packaging waste, establish and improve the recycling and treatment system, and promote the construction of facilities for the recycling and treatment of pesticide packaging waste.
Article 5 the agricultural and rural competent departments of the local people's governments at or above the county level shall be responsible for the supervision and administration of pesticide producers, operators and users in their respective administrative areas in fulfilling their obligations of recycling and disposing pesticide packaging wastes.
The competent ecological and environmental departments of the local people's governments at or above the county level shall be responsible for the supervision and administration of the prevention and control of environmental pollution in the recycling and treatment of pesticide packaging wastes within their respective administrative areas.
Article 6 pesticide producers (including enterprises exporting pesticides to China), operators and users shall actively perform the obligations of recycling and disposing of pesticide packaging wastes, and timely recover and dispose of pesticide packaging wastes.
Article 7 the State encourages and supports industry associations to play the role of organization and coordination, technical guidance and service provision in the recycling and treatment of pesticide packaging waste, and encourages and supports specialized service institutions to carry out the recycling and treatment of pesticide packaging waste.
Article 8 the agricultural, rural and ecological environment departments of the local people's governments at or above the county level shall, in various forms, carry out publicity and education on the recycling and treatment of pesticide packaging wastes, and guide pesticide producers, operators and specialized service institutions to carry out the recycling and treatment of pesticide packaging waste.
Pesticide producers, operators and social organizations are encouraged to carry out publicity and training on the recycling of pesticide packaging waste.
Chapter 2 recycling of pesticide packaging wastes
Article 9 the agricultural and rural competent departments of the local people's governments at or above the county level shall investigate and monitor the generation of pesticide packaging waste within their respective administrative areas, guide the establishment of pesticide packaging waste recovery system, reasonably arrange pesticide packaging waste recycling stations (stations) in counties, townships and villages, and clarify the management responsibilities.
Article 10 pesticide producers and business operators shall, in accordance with the principle of "Whoever produces, operates, recycles", perform the corresponding obligations of recycling pesticide packaging waste. Pesticide producers and business operators may negotiate to determine the specific way to fulfill the obligation of recycling pesticide packaging waste.
Pesticide operators shall set up pesticide packaging waste recycling devices in their business premises, and shall not reject the packaging wastes sold by them.
Pesticide producers and operators shall take effective measures to guide pesticide users to return pesticide packaging waste in time.
Article 11 pesticide users shall collect pesticide packaging wastes in time and return them to pesticide operators or pesticide packaging waste recycling stations (points), and shall not discard them at will.
In the process of application, pesticide users should make full use of the pesticide in the package by cleaning and other ways to reduce pesticide residues.
Encourage qualified places to explore the establishment of pesticide packaging waste cleaning and inspection mechanism such as inspectors.
Article 12 pesticide operators and pesticide packaging waste recycling stations (stations) shall establish a pesticide packaging waste recycling account to record the quantity and destination information of pesticide packaging waste. The recovery account shall be kept for more than two years.
Article 13 Pesticide producers shall improve the packaging of pesticides to facilitate cleaning and recycling.
The State encourages pesticide producers to use packaging materials that are easy to be recycled and disposed of, water-soluble polymer packaging materials or degradable packaging materials in the environment, and gradually eliminate aluminum foil packaging materials. Encourage the use of large capacity packaging that is easy to recycle.
Chapter 3 disposal of pesticide packaging wastes
Article 14 pesticide operators and pesticide packaging waste recycling stations (points) shall strengthen the management and maintenance of relevant facilities, equipment and places, properly store the collected pesticide packaging waste, and shall not dump, stack or scatter pesticide packaging waste without authorization.
Article 15 measures shall be taken to prevent environmental pollution in the transportation of pesticide packaging wastes. Pesticide packaging wastes shall not be discarded or scattered. The means of transportation shall meet the requirements of rain proof, leakage prevention and spillage prevention.
Article 16 The State encourages and supports the resource utilization of pesticide packaging waste; in addition to resource utilization, harmless disposal such as landfill and incineration shall be carried out in accordance with laws and regulations.
According to the principle of "controllable risk, fixed-point orientation and whole process tracing", the utilization of resources shall be concluded by the agricultural and rural authorities of the provincial people's government and the competent departments of ecological environment
